Join us as we keep using our playgrounds and parks. > The Minnesota Environmental Quality Board (EQB) did not even address the Ayd Mill Environmental Impact Statement (EIS) at its August 15 meeting. Instead they tried to sidestep the issue with some gibberish. Now we must tell them again to stop messing around and enforce the law. Again, please contact the Minnesota Environmental Quality Board (EQB) in the next few days to request that: "the EQB enforce the statutes and rules for the Ayd Mill EIS", See http://www.tc.umn.edu/~hause011/NF for legal references. Please call or write the CITIZEN MEMBERS at the EQB. The contact list of the EQB members are at the bottom of this email. If you call the EQB you do not need to recite details, but here is some background to know for your own information. Issues for the EQB and Ayd Mill Road: > No "Test" is in the scope of the Ayd Mill EIS (4410.2100). The test is large and expensive compared with the rest of the EIS, yet is not mentioned in the EIS scope. > No amendments to the scope of the Ayd Mill EIS about the "Test" have been published. (4410.5200) > The "Test" exceeds 4410.4600 thresholds as it connects to I-35E, is part of a phased project, is building the road before the EIS is done. > The "Test" does not fit the definition of 4410.4600 subpart 23 Research and Data collection as it "constitutes a substantial commitment to a further course of action having potential for significant environmental effects." The Mayor's staff repeatedly state that after a year the road will remain open including at the city council meeting of June 12, 2002. > The "Test" violates Minnesota Rules 4405.0300 Duty of Candor as Randy Kelly kept "Test" preparations a secret from the public, the City Council and the EQB. (and 4410.5200) > The EQB is responsible to enforce Environmental Impact Statement Rules. II.
